Terms and Conditions

FlightFollow is a free, informal and supplementary flight-following service. It is not an official flight plan, SARTIME or SARWATCH service, an air traffic control service, a distress beacon, an emergency service or a rescue service.

Do not rely on FlightFollow as your only means of flight tracking, overdue-aircraft alerting, communication or obtaining rescue. FlightFollow does not replace any flight plan or SARTIME lodged with Airways New Zealand, radio calls, required equipment, an ELT or PLB, standard aviation procedures, or contacting emergency services.

Monitoring and notifications can be delayed, unavailable or fail. If FlightFollow shows that monitoring cannot be verified, or if you have any doubt, use established aviation procedures and make other flight-following arrangements.

FlightFollow is provided by Jamie Barrow in New Zealand. By creating or continuing to use an account, you agree to these Terms and Conditions.

The service is currently provided without charge. Features may be changed, suspended or withdrawn, and any future paid service will be offered under separate or updated terms before charges apply.

The pilot-in-command remains solely responsible for the safe operation of the aircraft, all decisions concerning the flight, compliance with New Zealand civil aviation law, and using suitable official and informal flight-following arrangements.

You remain responsible for lodging, amending and closing any official flight plan or SARTIME, monitoring weather and fuel, maintaining communications, carrying and using required safety equipment, and taking appropriate action in an emergency. Registering or closing a flight in FlightFollow does not lodge, amend or close anything with Airways, ATC, RCCNZ, Police or any other authority.

You may register planned flight details, nominate followers and confirm safe arrival. FlightFollow attempts to monitor the times you enter and send available email, push or calendar notifications. Text messages are not included in the current free service.

Times, routes and estimated positions are based on information entered by the pilot unless clearly identified as coming from another source such as ADS-B. An estimated map position is a calculation only and is not evidence of the aircraft's actual location.

A follower is an informal contact chosen by the pilot. Followers are not FlightFollow staff, trained dispatchers, air traffic controllers or guaranteed responders. FlightFollow does not guarantee that any follower will receive, read or act on a notice.

The service depends on internet access, hosting, email and push providers, device settings, accurate user information and other third-party systems. Any of these may be unavailable, delayed, inaccurate or fail without warning.

A notice marked as sent or delivered means only that the relevant provider accepted or reported delivery of that notice. It does not prove the recipient saw it, that the aircraft is safe or overdue, or that emergency help has been requested.

You must check the monitoring status shown in FlightFollow and maintain an independent alternative appropriate to the flight. Never delay an emergency call while waiting for FlightFollow.

You must provide accurate, current flight, aircraft, pilot and contact information. You must have each nominated person's permission to provide their details and to ask them to receive flight-following notices.

FlightFollow uses pilot, flight and contact information to operate the service, send notices, maintain safety records and support users. Information may be disclosed to nominated contacts, Airways, RCCNZ, Police or other emergency responders when reasonably necessary to protect health or safety, respond to an incident, or comply with law.

You may ask to access or correct your personal information. Operational and acceptance records may be retained where reasonably required for safety, security, legal compliance and resolving disputes. Account information is protected using the service's access controls, but no online system can promise absolute security.

You must not use FlightFollow unlawfully, enter information you know is false, interfere with the service, access another person's information without authority, or use notifications to harass or mislead anyone.

You are responsible for protecting your account and private follower links. Tell FlightFollow promptly if you believe an account or link has been misused.

FlightFollow is offered on a reasonable-efforts basis for supplementary, informal use. To the maximum extent permitted by New Zealand law, no guarantee is made that monitoring will be continuous, information will be accurate, notifications will arrive, recipients will respond, or rescue will be initiated or successful.

To the maximum extent permitted by law, Jamie Barrow is not responsible for loss arising from reliance on FlightFollow as a primary or sole safety system, inaccurate user-entered information, communications or provider failures, a recipient's failure to act, or use contrary to these terms and displayed warnings.

Nothing in these terms excludes or limits rights or liability that cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, or any applicable rights under New Zealand consumer and fair-trading law.

You may stop using FlightFollow at any time. Access may be suspended or ended where reasonably necessary for safety, security, unlawful use, serious breach of these terms or discontinuation of the service.

These terms may be updated when the service or law changes. Material changes will require you to accept a new dated version before continuing to use protected flight features. Earlier acceptance records may be retained.

These terms are governed by New Zealand law. The New Zealand courts have jurisdiction. Before starting formal proceedings, both sides should try in good faith to resolve a concern directly, unless urgent relief is required.

If part of these terms is unlawful or unenforceable, the remaining parts continue to apply. These terms record the agreement about the free FlightFollow service, subject to any rights that the law does not allow to be excluded.
